1. Scope of the Terms and Conditions
1.1 These Terms and Conditions (hereinafter collectively referred to as "Terms") of www.addnear.com (hereinafter "ADDNEAR") apply to all services provided in the business directory www.addnear.com, unless special circumstances apply to a specific Service.1.2 On the ADDNEAR portal, users (hereinafter, "Users") can search for various information about companies and authorized individuals, this information being registered directly in the ADDNEAR business directory by the legal representatives of the companies and authorized individuals in question or taken from publicly accessible documents.
1.3 Treatment of companies and self-employed professionals:
- Companies (legal entities, primarily located in the United States): Business data may be collected and published automatically in the directory based on publicly available sources (for example, OpenStreetMap) or voluntarily provided by business owners or their authorized representatives. If a company wishes to add optional data such as photos, email addresses, or other sensitive information, it must first register in ADDNEAR.
- Self-employed professionals (natural persons) located in Spain or the European Union: Because this constitutes personal data under European law, information about self-employed professionals will only be included in the directory after prior registration and the individual’s explicit consent. We do not import freelancer profiles from public data sources without such consent, in order to comply with the GDPR and applicable Spanish data protection regulations.
Customers (hereinafter referred to as "Clients") may be natural persons, legal entities, partners, or authorized private associations who present their activities in ADDNEAR using the services offered on the portal, or who use the different registration request services.
1.4 Users or clients may request the services of the portal offered with or without registration solely on the basis of these terms and conditions. The validity of other conditions is excluded. The terms listed here also apply if ADDNEAR fulfills an unconditional request knowing the client's divergent conditions, even if they differ from those listed here. ADDNEAR employees are not automatically authorized to make additional verbal agreements.
1.5 Business Data Sources & Attribution (OpenStreetMap)
ADDNEAR may populate business listings using public data from OpenStreetMap (“OSM”) via services such as Nominatim and the Overpass API.

We may normalize, format, or enrich such data for display and quality purposes. If you are a rights holder or a business owner and wish to claim, update, or remove a listing, contact info@addnear.com.
“OpenStreetMap” is a trademark of the OpenStreetMap Foundation (OSMF). The use of the OSMF trademark by ADDNEAR does not imply endorsement by the OSMF.
2. Preliminary Conditions for the Use of www.addnear.com
2.1 By using the services of the portal, the client or user agrees to comply with these Terms during their use of the website.2.2 To publish listings, present their business, or use specific services, clients must first register. Registration is free. If the client has not completed a registration request form and the data was taken from public sources, ADDNEAR reserves the right to cancel the registration if it is impossible to update the data from public sources, without providing written notice to the client. When completing the registration form, all information must be genuine, accurate, current, and complete. The client is obliged to verify their listings regularly and update their contact information and offers.
2.3 Publication of data depending on client type:
- Companies (legal entities): General information (such as business name, phone, address, and hours) may be published directly by ADDNEAR from public sources. However, to include optional or sensitive information (such as photos, logos, emails, or others), the company must register and verify its profile.
- Self-employed professionals (natural persons): Data will not be included in the directory until the professional registers and provides explicit consent for the use of their information.
2.4 If the client fails to meet the obligations regarding the accuracy and completeness of the information in required fields, ADDNEAR has the right to temporarily or permanently remove their registration and prohibit the client from using services that require registration.
2.5 Minors must not use the services of the portal without the consent and supervision of their parents or legal guardians. The service is not directed to children under 13, and we do not knowingly allow them to create accounts or submit information (see Section 14).
2.6 Services requiring registration may only be used by natural persons with full legal capacity, over eighteen years old, authorized legal entities, and natural persons with residence and business address in any country worldwide. Access to the portal will be automatically canceled when a client permanently relocates their residence or the data is transferred to the portal of the country where the new residence is located. The client must immediately inform ADDNEAR when permanently changing residence.
2.7 Limitation of liability: ADDNEAR does not guarantee the accuracy of data provided by users and is not responsible for damages resulting from the use of incorrect or incomplete information.
3. Customer and User Support
3.1 All portal services are free of charge.3.2 The use of the search functions and services of the ADDNEAR portal does not create any contractual relationship between the user and the provider. Therefore, no contractual or quasi-contractual claims may be made against ADDNEAR. Likewise, no claims may be made against ADDNEAR regarding online publication services.
3.3 ADDNEAR grants users and clients a simple, non-transferable, non-exclusive right, unlimited in time and geography, to use the provided information. This basic right is limited to searching and viewing information for personal use only. Any other use of the information is prohibited. Industrial or commercial misuse of the information presented on the site, the creation of directories, electronic or printed databases, reproduction, processing, or distribution of the information to third parties is strictly prohibited. The user may use the portal only in compliance with legal provisions, in particular with data protection regulations.
3.4 Visitors acknowledge that all rights and responsibilities related to the use of the portal content — especially copyright, usage rights, databases, and contact information files — belong to ADDNEAR or third parties, particularly clients and license providers. The portal’s databases are protected by copyright. By using the portal, users must also respect third-party license terms, in addition to these Terms.
3.5 In the event of violation of usage rights, clients and users are fully liable for damages arising therefrom.
3.6 The user or client agrees to promptly report to ADDNEAR any errors or interruptions of service, as well as any threats or evidence of abuse committed by others.
3.7 Users or clients may not post or transmit software viruses or any other information, data, programs, or content by email or any other means intended to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment.
3.8 For all information: photos, graphics, videos, news, data, text, software, music, sound, or any other type of content — whether published publicly or transmitted privately — full responsibility lies solely with the person who provided such content.
3.9 ADDNEAR does not verify any content published by registered clients or users through the portal and assumes no responsibility for the accuracy, completeness, or quality of such content.
3.10 ADDNEAR has no control over content published by users and clients. Business presentation pages may not contain references to pornography, adult or mature content, excessive profanity, content promoting racial intolerance or hostility against individuals, groups, or organizations, pirated content, illicit drugs and related paraphernalia, gambling or casino content, sale of beer or hard alcohol, sale of tobacco or related products, sale of weapons or ammunition, or any other content that is illegal, promotes illegal activities, or infringes the legal rights of others. We reserve the right to immediately remove any business presentation page that contains such content. Likewise, no data, text, image, file, link, software, or content deemed illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racist, or otherwise objectionable by ADDNEAR may be published.
3.11 Sending spam to the ADDNEAR portal is prohibited. This includes especially sending illegal or unsolicited advertising to third parties. When sending emails, it is also prohibited to provide false information about the sender or to conceal identity in any way.
4. Obligations of Registered Account Holders
4.1 When registering on the ADDNEAR portal, the account holder may not share their assigned or chosen password with third parties. The account holder is responsible for all activities carried out using their password. The account holder must immediately notify ADDNEAR of any unauthorized use of their password and any other security breach. To avoid possible misuse, the account holder must use the “Log out” button provided at the end of their session.4.2 The client must provide all necessary information to implement the service. The client grants the right for the storage and publication of data and information and agrees to comply with data protection regulations. ADDNEAR publishes the content online and free of charge for its users.
4.3 The client is fully responsible for the accuracy and legality of the information provided. This is especially true for clients with a protected professional title or members of a professional association (e.g., architects, doctors, merchants, lawyers, notaries, and accountants). The client explicitly guarantees that the registered data complies with applicable local laws.
4.4 The client agrees to indemnify ADDNEAR against any third-party claims arising from illegally published information. This indemnification obligation includes fully releasing the portal operator from the costs of legal defense (e.g., attorneys, court fees, appellate court, and legal expenses).
4.5 ADDNEAR may send information and explanations regarding the Terms, in particular, to the client’s email address. The client is responsible for regularly checking the email address through which they contact ADDNEAR.
4.6 ADDNEAR has the right to regularly inform the client about news and new services offered in the form of a newsletter and to request that the client review the accuracy of published data and update it if necessary. If ADDNEAR has reason to believe that published information is false, inaccurate, outdated, or incomplete, ADDNEAR may request that the client update the information by email at any time. If the client does not respond, ADDNEAR may delete their profile. The client has the option to unsubscribe from the newsletter at any time.
4.7 The registered account holder is fully responsible for access control and for any misuse committed during their access due to neglect of security measures.
5. Rights of Use
5.1 ADDNEAR is authorized to store content and disclose it to third parties insofar as required by law or necessary and/or permitted by law, in order to comply with legal provisions or judicial/administrative orders, to enforce these Terms and Conditions, to respond to allegations of copyright infringement by third parties, or to protect the rights, property, or personal safety of ADDNEAR, users, and clients.5.2 ADDNEAR emphasizes that the technical processing and transmission of client content may take place across various networks. Such content may be slightly modified to meet the technical requirements of network connections or other devices (e.g., different internet browsers).
5.3 The client represents and warrants that they have all rights necessary to publish all texts and materials online. The client transfers to ADDNEAR all rights necessary for the online publication of their listings, namely: usage rights, service protection, and other rights, particularly the rights of publication, reproduction, and distribution of corporate logos and images, as well as the content and validity period of offers.
5.4 By accessing or using our contact form, you agree to the following conditions of use:
You may use our platform to send an email message to an individual, company, or other organization identified for the purpose of obtaining information about products and services they may offer. You must not use our contact form to send spam or unsolicited marketing to such organizations.
We may use personal data in aggregated form to monitor and evaluate our contact form services and to inform you of significant changes regarding your actions while using ADDNEAR.
6. Disclaimer; Limitation of Liability
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADDNEAR DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ADDNEAR DOES NOT GUARANTEE THE COMPLETENESS, ACCURACY, OR RELIABILITY OF INFORMATION PROVIDED BY USERS OR IMPORTED FROM PUBLIC SOURCES (INCLUDING OPENSTREETMAP), AND YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, ADDNEAR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. IN ANY EVENT, ADDNEAR’S AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) EUR 100 OR (B) THE AMOUNTS PAID BY YOU TO ADDNEAR IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
ADDNEAR IS NOT RESPONSIBLE FOR CONTENT OR ACTIVITIES PROVIDED BY USERS OR CLIENTS (INCLUDING LINKS, PROFILE INFORMATION, REVIEWS, COMMENTS, PHOTOS, AND VIDEOS). SERVICE INTERRUPTIONS MAY OCCUR (E.G., MAINTENANCE OR SERVER ISSUES); ADDNEAR ASSUMES NO LIABILITY FOR SUCH INTERRUPTIONS. BECAUSE THE DIRECTORY SERVICE IS PROVIDED FREE OF CHARGE, NO SERVICE-LEVEL COMMITMENTS APPLY.
6.1 ADDNEAR is not responsible for the content or activities provided by users and clients of the portal. Such information cannot be attributed to the operator of www.addnear.com and does not represent its views. Content includes links, profile information, reviews, comments, photographs, and videos published on portal web pages.6.2 ADDNEAR places great emphasis on the reliability of its servers, operating with the least possible interruptions. However, interruptions caused by maintenance or server failures cannot be ruled out. Therefore, ADDNEAR assumes no liability for such interruptions.
6.3 ADDNEAR assumes no liability for damages resulting from the use of the business directory by clients or users, since, in the case of such free services, no service contract exists in the legal sense. Claims for lost profits, third-party indemnity claims, or other direct or indirect damages resulting from interruptions cannot be invoked.
7. Security of Personal Data Processing
7.1 The measures adopted and implemented by IGNACIO BARAHONA ORMAZABAL are based on the need to maintain confidentiality and integrity of personal data, in line with minimum security requirements for processing personal data.7.2 We use all necessary technical and organizational security measures to protect authentication information, passwords, or any other data recorded for security purposes, against manipulation, loss, destruction, or unauthorized access, whether deliberate or accidental. The methods used comply with generally accepted standards in this field.
7.3 Registration Data: By submitting a form on this platform, we collect and store information such as IP address, email address, name, address, and submission time. This information is used exclusively to ensure the security and traceability of records, in accordance with our Privacy Policy.
8. Public Content Rights
8.1 If a client or user publishes content or files in publicly accessible areas, they grant ADDNEAR the right to use such content (in whole or in part) globally, to reproduce, modify, adapt, and publish it, solely for the purpose of presentation, distribution, and promotion of said content.8.2 This right is valid only during the period in which the client or user’s content is published. Clients may delete their publication from the portal at any time, regardless of ADDNEAR.
8.3 If the client or user does not have the right to publish certain content, they must ensure that the content rights holder has accepted the transfer of rights under the provisions stated above.
8.4 To better adapt current and future services to client needs, the client agrees that a pseudonym may be used when requesting services. Authenticated data of the pseudonym, in accordance with the law, will not be merged with the data of the pseudonym owner. ADDNEAR uses these protocols solely for its own purposes and in the interest of its clients to develop new services. There will be no transfer of personal data to third parties.
9. Jurisdiction
9.1 The exclusive place of jurisdiction for all disputes related to the services provided by ADDNEAR is Barcelona, Spain. For all claims of any kind arising from or in connection with a situation under these Terms and Conditions, Spanish law shall apply.10. Severability
10.1 If any provisions of these Terms, in whole or in part, become invalid or lose their legal effect, the validity of the remaining Terms shall not be affected. In place of the ineffective provisions, the statutory provisions shall automatically apply. The same applies in the event of possible omissions in the Terms.11. Data Protection
11.1 Your personal data (address, email address, telephone number) will be processed by us solely in accordance with data protection regulations and will not be visible to any other User of the ADDNEAR Business Directory, while the telephone number (which is not mandatory to provide) will only be visible to the service provider if they choose to display it. Your personal data will not be shared with third parties without your explicit consent. We will take all necessary technical and organizational security measures to protect your login information, passwords, or any other data recorded for security purposes, against accidental or intentional manipulation, loss, destruction, or unauthorized use or access. To meet protection requirements, the methods we use comply with generally accepted standards in this field.11.2 When a User logs in with a Facebook or Google account, the name and profile picture will be visible to all Users of the ADDNEAR Business Directory.

14. Children & Teens
This website is not directed to children under 13, and we do not knowingly allow them to create accounts or submit information. If you believe a child under 13 has provided data, please contact us to remove it. Users aged 13 to 17 may use the service only with consent and under the supervision of a parent or legal guardian. California residents under 18 may request removal of content they posted publicly (“Online Eraser”); write to info@addnear.com with sufficient detail to locate the content.
15. Acceptable Use
You agree not to: (a) scrape, harvest, or bulk-export listings, emails, or phone numbers; (b) bypass access controls, rate limits, or security; (c) use bots or automated queries except via interfaces we explicitly provide; (d) frame, resell, or sublicense directory data; (e) upload malware or impair the service; (f) use the service to spam or for unlawful purposes.
16. Intellectual Property & Takedown
If you believe content on Addnear infringes your rights, send a notice including: (i) identification of the work or mark; (ii) the allegedly infringing material and its URL; (iii) your contact details; (iv) a statement of good-faith belief; (v) a statement under penalty of perjury that the information is accurate and you are authorized; and (vi) your signature. 17. Changes to the Service and to these Terms
